The City of Dripping Springs will consider a request to amend the Amended and Restated Development Agreement between the City of Dripping Springs and Scenic Land Holdings, LLC, to reflect the following revision: a transfer and dedication of two (2) acres of land to be given to the City as a Civic Site to be transferred to the Veterans of Foreign Wars (VFW) Post 2933, P.O. Box 1413, Dripping Springs, Texas 78620.

APPLICATIONS TO DRIPPING SPRINGS LOCAL HOTEL OCCUPANCY TAX GRANT PROGRAM DUE AUGUST 4TH

The City of Dripping Springs is accepting applications for the Local Hotel Occupancy Tax Grant Program for projects/expenditures that directly enhance and promote tourism and the convention and hotel industry.  Projects must increase overnight stays in the area and meet one of the statutory categories for expenditure: 1) convention and visitor centers; 2) convention registration; 3) advertising, solicitation, and promotions that attract tourists and convention delegates to the city or its vicinity; 4) expenditures that promote the arts; 5) historical restoration and preservation programs; 6) sporting events; 7) funding transportation systems for tourists; and 8) funding signage directing tourists to sights and attractions that are visited frequently by hotel guests in the municipality.  The grant guidelines and application are available at City Hall, 511 Mercer Street, and on the city’s website at www.cityofdrippingsprings.com. CITY OF DRIPPING SPRINGS NOTICE OF PUBLIC MEETING

NOTICE IS HEREBY GIVEN THAT a quorum of the Dripping Springs Emergency Management Commission may assemble for the North Hays County Fire Rescue After Action Review of Blue Blazes Pipeline Incident on Friday, June 23, 2017. The event will be held at North Hays County Fire Rescue Station 71 located at 400 Sportsplex Drive, Dripping Springs, TX 78620. The After Action Review meeting will begin at 10:00 a.m. City of Dripping Springs business will not be deliberated and no vote will be taken but the commission members will participate in the meeting. All discussion of city business will be related to the Blue Blazes incident.

The City of Dripping Springs will consider a request to enact an ordinance in Compliance with Article 30.03 of the Dripping Springs Code of Ordinance to create Planned Development District # 7 (“PDD 7”), which shall encompass the boundary of the property commonly known as Westwood, and further establish regulations and guidelines for the development and construction of a master-planned, residential project and other roadway and utility infrastructure improvements including the incorporation and operation of a homeowners association and its related functions and facilities; and provide for the following: rules; standards; procedures; criminal penalties; and, severability.

PDD 7 is approximately 680.012 acres, located at 4116 West U.S. Highway 290.  PDD 7 utilizes conservation design principles and will encompass a master-planned residential community incorporating a mix of housing and parks and open space. PDD 5 is approximately 189 acres, generally bounded by Ranch Road 12 near the northeast perimeter of the property; Old Fitzhugh Road near the eastern perimeter; Walnut Springs Elementary School in the southwestern corner; Dripping Springs Youth Sports Association Fields near the southwest perimeter; Dripping Springs High School along the western perimeter; and in close proximity to Springlake Drive at the northern perimeter. A detailed description of the property is available at City Hall. 

PDD 5 will encompass a master-planned community incorporating a mix of housing, parks and open space, commercial, office, and institutional/governmental land uses. PUBLIC NOTICE IS HEREBY GIVEN FOR THE FORMATION OF WESTWOOD PUBLIC IMPROVEMENT DISTRICT (PID) ON FEBRUARY 15, 2017 BY THE CITY OF DRIPPING SPRINGS IN HAYS COUNTY, TEXAS.

RESOLUTION NO.  2017-25

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DRIPPING SPRINGS, TEXAS, CREATING THE WESTWOOD PUBLIC IMPROVEMENT DISTRICT PURSUANT TO CHAPTER 372 OF THE TEXAS LOCAL GOVERNMENT: AND PROVIDING AN EFFECTIVE DATE

WHEREAS, the City Council of the City (the "City Council") of Dripping Springs, Texas (the "City") has received a petition (the "Petition") requesting creation of a public improvement district (the "District") under Chapter 372 of the Texas Local Government Code (the "Act"), from the record owners of taxable real property representing more than fifty percent (50%) of the appraised value of the real property liable for assessment (as determined by the most recent certified appraisal roll for Hays County) in the District and the record owners of taxable real property that constitute more than 50% of all of the area of all taxable real property that is liable for assessment under the proposal; and

WHEREAS, the Petition, has been examined, verified, and found to meet the requirements of Section 372.005(b) of the Act and to be sufficient for consideration by the City Council; and

WHEREAS, the boundaries of the District are described below, with metes and bounds available at City Hall, said area for the District being within the extraterritorial jurisdiction of the City and it is anticipated that the District will be annexed into the City limits; and

WHEREAS, after providing all notices required by the Act, the City, on February 15, 2017, conducted a public hearing on the advisability of the improvements and services described in the Petition; and

WHEREAS, the City Council adjourned and closed the public hearing.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DRIPPING SPRINGS, TEXAS:

SECTION 1:  The findings set forth in the recitals of this Resolution are hereby found to be true and correct.

SECTION 2:  The Petition submitted to the City was filed with the City Secretary and complies with Subchapter A of the Act.

SECTION 3.  Pursuant to the requirements of the Act, the City Council, after considering the Petition and the evidence and testimony presented at the public hearing on February 15, 2017, hereby finds and declares:

(a)             Advisability of the Proposed Improvements.  It is advisable to create the District to provide the Authorized Public Improvements described in the Petition and this Resolution.  The Authorized Public Improvements will promote the interests of the City and will confer a special benefit on the District.

(b)            General Nature of the Improvements.  The public improvements for the District (the “Authorized Improvements”) may consist of one or more of the public improvements included in Section 372.003(b) of the Act. The general nature of the Authorized Improvements are: (i) the establishment of parks and open space, together with the design, construction and maintenance of any ancillary structures, features or amenities such as trails, pavilions, community facilities, irrigation, walkways, lighting, benches, swimming pools, trash receptacles and any similar items located therein; (ii) landscaping; (iii) acquisition, construction, and improvement of water, wastewater and drainage facilities; (iv) acquisition, construction and improvement of streets, roadways, rights-of-way and related facilities; (v) entry monumentation and features; (vi) signage; (vii) projects similar to those listed in subsections (i) – (vi) above; and (viii) payment of costs associated with constructing and financing the public improvements listed in subparagraphs (i) – (vii) above, including costs of establishing, administering and operating the District.

(c)             Estimated Cost of the Authorized Improvements.  The estimated cost to design, acquire and construct the Authorized Improvements is $40,890,000.00 (including issuance and other financing costs).

(d)            Boundaries.  The boundaries of the District are set forth below and metes and bounds are available at City Hall. 

(e)             Proposed Method of Assessment.   An assessment methodology will be prepared that will address: (i) how the costs of the Authorized Improvements financed with the assessments are assessed against the property in the District, (ii) the assessments to be collected each year, and (iii) reduction of the assessments for costs savings (pursuant to the annual review of the service plan for the District).  Additionally, a report will be prepared showing the special benefits accruing to property in the District and how the costs of the Authorized Improvements are assessed to property on the basis of the special benefits. The result will be that equal shares of the costs will be imposed on property similarly benefited.

The assessment methodology will result in each parcel paying its fair share of the costs of the Authorized Improvements provided with the assessments based on the special benefits received by the property from the Authorized Improvements and property equally situated paying equal shares of the costs of the Authorized Improvements.

(f)             Apportionment of Cost between the City and the District.  Approval and creation of the District will not obligate the City to provide any funds to finance the proposed Authorized Improvements.  All of the costs of the proposed Authorized Improvements will be paid by issuance of bonds secured by, or directly by, assessments of the property within the District and from other sources of funds, if any, available to the owner of the Land.

(g)            Management of the District.  The District shall be managed by the City with the assistance of a consultant or third-party administrator, who shall, from time to time, advise the City regarding certain operations of the District.

(h)            Advisory Body.  The District shall be currently managed without the creation of an advisory body.  The City Council reserves the right to appoint an advisory body in the future.

SECTION 4.  The Westwood Public Improvement District is hereby authorized and created as a Public Improvement District under the Act in accordance with the findings as to the advisability of the Authorized Improvements contained in this Resolution.

SECTION 5. The City’s staff is directed to give notice of the authorization for the establishment of the Westwood Public Improvement District by publishing a copy of this Resolution once in a newspaper of general circulation within the City.  Such authorization shall take effect and the Westwood Public Improvement District shall be deemed to be established effective upon the publication of such notice.  The Westwood Public Improvement District shall exist until dissolved or terminated as provided by law.

SECTION 6.  This Resolution shall take effect immediately from and after its passage and it is accordingly so resolved.

NOTICE OF PUBLIC HEARING REGARDING APPROVING THE PROJECT PLAN AND FINANCING PLAN FOR REINVESTMENT ZONE NUMBER TWO, ARROWHEAD TIRZ, CITY OF DRIPPING SPRINGS, TEXAS, AND ESTABLISHING THE BOUNDARIES OF THE ZONE PURSUANT TO CHAPTER 311, TEXAS TAX CODE

 

Notice is hereby given that a public hearing shall be conducted by the City Council of the City of Dripping Springs, Texas, on November 29, 2016, at 5:30 P.M., at the Dripping Springs City Hall, 511 Mercer Street, Dripping Springs, Texas, for the City Council to consider the approval of the project plan and financing plan for Reinvestment Zone Number Two, Arrowhead TIRZ, City of Dripping Springs, Texas, and the benefits thereof to the City and the property within the reinvestment zone, pursuant to Chapter 311, Texas Tax Code. The proposed project plan and financing plan include establishing the boundaries of the reinvestment zone and providing the total estimated project costs of the reinvestment zone for projects.  Projects include parking, ancillary and supporting infrastructure including roads, utilities, drainage improvements, municipal buildings, landscaping, and open space improvements, lighting, walkways, plazas, and similar improvements. The area of the reinvestment zone as proposed is the Arrowhead and Bunker Ranch developments, south of 290 to Creek Road, west of Roger Hanks Parkway to just east of Blue Creek Road.  Any person owning property within the proposed TIRZ may file a written protest of inclusion in the TIRZ with the City or submit their protest of inclusion in the TIRZ at the public hearing. PUBLIC NOTICE OF PROPOSED ORDINANCE TO CREATE PLANNED DEVELOPMENT DISTRICT NUMBER 6

The City of Dripping Springs will consider a request to enact an ordinance in Compliance with Article 30.03 of the Dripping Springs Code of Ordinances to create Planned Development District (“PDD”) Number 6, which shall encompass the boundary of the commercial property located in what is commonly known as Headwaters at Barton Creek, and further establish regulations and guidelines for the development and construction of the mixed-use, master-planned project and provide for the following: rules; standards; procedures; criminal penalties; and, severability.

PDD 6 is approximately 166.801 acres, generally bounded by Hwy 290 along the southern boundary; North Canyonwood Drive along the eastern boundary; and the western boundary is in proximity to East Creek Drive, south of Headwaters. The legal description of the property is available for viewing at City Hall.

PDD 6 will encompass a master-planned community incorporating a mix of multifamily housing, trails and open space, and commercial, and office land uses. To allow for the mixture of uses in the subdivision, some modifications of the City’s Code of Ordinances may be necessary, including but not limited to, setbacks, lot sizes, building height, and permitted uses. NOTICE OF PUBLIC HEARING

On the 13th day of September, 2016 at 7:00 p.m. in the City Council Chambers of the City of Dripping Springs, Texas, the City Council shall hold a public hearing and take action on the adoption of the Fiscal Year 2017 Budget.  A copy of the proposed Fiscal Year 2017 Budget is on display during regular business hours at City Hall for public viewing. This budget will raise more total property taxes than last year’s budget by $83,828, and of that amount 15.62% is tax revenue to be raised from new property added to the tax roll this year. The property tax revenue to be raised from new property added to the tax roll this year is $48,614.

Separate sealed bids addressed to the City of Dripping Springs will be received until 10:00 A.M. on Thursday the 15th day of September, 2016 at the City of Dripping Springs City Hall located at 511 Mercer Street in Dripping Springs, Texas at which time they will be publicly opened and read aloud for furnishing all labor, material, tools and equipment and performing all work required for WATER LINE REPLACEMENT - NORTH FORTY ADDITION consisting of 
• approximately 5,850 feet of 6" PVC C-900 DR-18, 
• 1,680 feet of 1" and 1 ½" polyethylene service tubing, 
• 8 fire hydrants, 
• 96 service reconnections to new pipe, 
• 11 gate valves,

A non-mandatory Pre-Bid Conference shall be conducted at City Hall on Thursday at 10:00 A.M. on the 8th day of September, 2016.  Bidders are encouraged to attend and make themselves familiar with all existing site conditions.  The City encourages Section 3 Businesses and HUBS to attend the Pre-Bid Conference and to participate in this project as bidders and/or subcontractors. 

Bids must be submitted on the Bid Forms provided and  must be accompanied by a bid security.  A bid bond in the amount of 5 percent of the bid issued by an acceptable surety shall be submitted with each bid.  A certified check or bank draft payable to the City of Dripping Springs or negotiable U.S. Government Bonds (as par value) may be submitted in lieu of the bid bond.   

Attention is called to the fact that not less than the federally determined prevailing (Davis-Bacon and Related Acts) wage rate, as issued by the Texas Department of Agriculture Office of Rural Affairs and contained in the contract documents, must be paid on this project.  In addition, the successful bidder must ensure that employees and applicants for employment are not discriminated against because of race, color, religion, sex, sexual identity, gender identity or national origin. 

The envelope containing the bid shall indicate clearly on the front that it is a bid for  WATER LINE REPLACEMENT - NORTH FORTY ADDITION.

The final Notice of Award of Contract shall be given to the successful bidder by the City within thirty (30) days following the opening of bids and no bidder may withdraw his bid within thirty (30) days after opening thereof.  The successful Bidder must furnish a performance bond and payment bond on the forms provided, each in the amount of one hundred percent (100%) of the contract amount, from a surety company holding a permit from the State of Texas to act as surety.  The successful Bidder must also furnish Certificates of Insurance in the amounts set forth in the contract documents.

All contractors/subcontractors that are debarred, suspended or otherwise excluded from or ineligible for participation on federal assistance programs may not undertake any activity in part or in full under this project.

Notice - Planned Improvement District

This notice serves to inform citizens, in accordance with Texas Local Government Code §372.009, the City Council of Dripping Springs will hold a public hearing beginning at 7:00 pm on May 17, 2016  at the City Hall Chambers, 511 Mercer Street, Dripping Springs, Texas. The City of Dripping Springs (the “City”) is considering the creation of the Heritage Public Improvement District (“PID”) in the area commonly known as Heritage Subdivision. A map and detailed description of the property is located at City Hall.

It is currently anticipated that the public improvements will consist of the design, engineering, construction, operation and maintenance of the following public improvements to serve the PID:

  1. Water distribution system
  2. Wastewater collection and treatment
  3. Stormwater drainage and detention system
  4. Parks, open space, trails and landscaping
  5. Public streets

Special supplemental services including engineering, planning, landscape architecture, legal services, PID creation and administration costs may also be funded by the PID.  

The estimated cost of the public improvements is approximately $17,700,000 (including issuance and other financing costs).  However, the PID petition authorizes up to $25,000,000 in bonds

The proposed method of assessment is to assess the property owners on an annual basis, a fixed amount based on the estimated build out value of each parcel. The annual assessment is anticipated to be approximately $0.68 per $100 of assessed valuation for thirty two (32) years.

Please note that the information related to types of improvements to be funded by the PID, estimated cost of the public improvements, method of assessments and assessment amounts are subject to change.
